1 DIVINE INTEL PAYMENT TERMS, DEPOSITS, AND CANCELLATION POLICY

1. Due Diligence, Digital Investigation, or Research Support/Services Cancellation

1.1 CANCELLING DUE DILIGENCE, DIGITAL INVESTIGATION, OR RESEARCH SUPPORT/SERVICES

(a) Upon execution of any Letter of Engagement or Agreement, you may select one of the payment structures listed in the Standard Payment Options section.

(b) The percentage of the deposit due at engagement corresponds to the payment period selected for the remaining balance.

(c) All payment periods are measured in calendar days (inclusive of weekends and holidays).

(d) The structure below reflects administrative and opportunity costs incurred in scheduling, resourcing, and prioritizing your project.

1.2 STANDARD PAYMENT OPTIONS

(a) Payment Period 15 days = 35% Deposit Required (of Project Estimate) & 2.0%  Late Fee (Monthly, & Possibly Compounding on Outstanding Balance). Ideal for small organizations with fast internal approvals; immediate payment capability.

(b) Payment Period 30 days = 55% Deposit Required (of Project Estimate) & 2.75%  Late Fee (Monthly). Ideal for large firms with multi-step billing cycles.

(c) Payment Period 45 days (or more) = 70% Deposit Required (of Project Estimate) & 3.5%  Late Fee (Monthly). Ideal for enterprise clients with quarterly accounting systems.

1.3 LATE FEES

(a) Late fees are calculated monthly and compound until the account is paid in full.

(b) Payment periods are measured in calendar days, including weekends and holidays.

(c) Late fees are calculated monthly and are not compounded until the account is paid in full unless otherwise prohibited by law.

(d) Invoices unpaid beyond 60 calendar days may be subject to suspension of services or referral for collection.

1.4 TERMINATION FEES

(a) If a project is cancelled after execution, Divine Intelligence bills for services already rendered, any expenses incurred, and may apply a termination fee based on the percentage of completion as follows:

Project Completion at Time of Cancellation | Termination Fee (of Total Estimate)

  1. 00%–25% completed   =   Up to 15%
  2. 25%–49% completed   =   Up to 10%
  3. 50%–74% completed   =   Up to 5%
  4. 75% or more completed No additional fee beyond work performed and expenses incurred

2 Digital Forensics Expert Testimony Cancellation

2.1 Cancelling Digital Forensics Expert Testimony

(a) If you schedule expert testimony by our digital forensics expert, a retainer of $2,500.00 (Two thousand five hundred US Dollars) is due upon scheduling of the appearance date.

(b) The Expert Witness Appearance Rate, including testimony at depositions, in court, virtual appearances, or stand-by status to testify, is charged at $2,500.00 per day or any part thereof.

(c) If an appearance or stand-by status is cancelled or rescheduled less than 96 (ninety-six) hours prior to a scheduled appearance—or after travel to a scheduled appearance has commenced—you shall pay a cancellation fee equal to the daily appearance rate for one day, plus any actual expenses incurred.

(d) It is your responsibility to ensure any cancellation notices are received before the 96-hour window.  All email notices should be followed by a phone call (with voicemail), AND a text message (if available). If you choose not to execute all of the above, and your communication is not acknowledged by a human responding to it, then it is not considered received.  However, if you do all of the available (email, phone call with voicemail, text, and a chat platform posting in a channel if available) then your communication is considered received even without human response.

a) All concerns or questions can be submitted in writing per the instructions in your Letter of Engagement or equivalent Agreement.  If none are specified, submit to the email address below. We do not accept complaints or refund requests via telephone; however, we may call you, email you, or schedule a Microsoft Teams meeting to resolve your concern.

4 MODIFICATION OF THIS CANCELLATION POLICY

4.1 Divine Intel reserves the right to modify or amend this Cancellation Policy at any time, for any reason, and without any notice, by posting a revised version on our Website or Platforms. Any changes to this Cancellation Policy will become effective when Divine Intel posts the revised Cancellation Policy on the Website or Platforms. Your browsing of our Website or use of the Services (not including memberships and courses) following these changes means that you accept the revised Cancellation Policy.
